This article argues for a systemic conception of freedom as non-domination. It does so by engaging with the debate on the so-called coalition problem. The coalition problem arises because non-domination holds that groups can be agents of power, while also insisting that freedom be robust. Consequently, it seems to entail that everyone is in a constant state of domination at the hands of potential groups. However, the problem can be dissolved by rejecting a ‘strict possibility’ standard for interpreting non-domination’s robustness (...) requirement. Frank Lovett and Philip Pettit propose to restrict the relevant domain of possible worlds by reference to two epistemic conditions pertaining to potential group members. I argue that this strategy unduly limits non-domination’s critical potential. I then argue that a suitably systemic conception of domination avoids this problem. By placing explanatory emphasis on social institutions, and how these bear on the feasibility of individual and collective action, a systemic conception of non-domination avoids the coalition problem in a way that retains its critical potential. The article clarifies the relationship between the rule of law and the social norms and objects to the claim that non-domination is bound to deem the latter irrelevant from the point of view of freedom. In the last seven years, close to twenty thousand people have died trying to reach Europe by crossing the Mediterranean Sea. Rescue missions by private actors and NGOs have increased because both national measures and measures by the EU’s border control agency, Frontex, are often deemed insufficient. However, such independent rescue missions face increasing persecution from national governments, Italy being one example. This raises the question of how potential migrants and dissenting citizens should act towards the EU border regime. In (...) contrast to the literature, which mainly addresses migration on the basis of justice requirements, this article focuses on the legitimate authority of the EU’s border regime. Focusing on the legitimacy criteria for states’ claims to regulate migration opens a fruitful normative perspective, given the pervasive disagreement over the content of justice in migration. What reasons for compliance and non-interference does legitimacy supply for potential immigrants and dissenting citizens? And what legitimacy standard may be appropriate for the power that individual states claim over potential immigrants? We argue that, even assuming a minimal legitimacy standard for the state-migrant relationship, the structure of the EU’s border regime exhibits unique features, which cause it to stand in tension with such a standard. By coordinating its Member States’ border regimes, especially through Frontex, the EU claims and exercises power over potential immigrants. However, the asymmetrical delegation of state powers to the EU means that the power involved in regulating European borders is, in core respects, unaccountable. This unaccountability, we argue, is significant for the legitimacy of the EU’s border regime. It is a popular view thatpractical deliberation excludes foreknowledge of one's choice. Wolfgang Spohn and Isaac Levi have argued that not even a purely probabilistic self-predictionis available to thedeliberator, if one takes subjective probabilities to be conceptually linked to betting rates. It makes no sense to have a betting rate for an option, for one's willingness to bet on the option depends on the net gain from the bet, in combination with the option's antecedent utility, rather than on the offered (...) odds. And even apart from this consideration, assigning probabilities to the options among which one is choosing is futile since such probabilities could be of no possible use in choice. The paper subjects these arguments to critical examination and suggests that, appearances notwithstanding, practical deliberation need not crowd outself-prediction. (shrink)

Recent years have seen the emergence of a new brand of moral philosopher. Straddling the gap between academia on the one hand, and the world of law, medicine, and politics on the other, bioethicists have appeared, offering advice on ethical issues to a wider public than the philosophy classroom. Some bioethicists, like Peter Singer, have achieved wide notoriety in the public realm with provocative arguments that challenge widely held beliefs about the relative moral status of animals, human foetuses and newborn (...) babies. Other bioethicists practice their trade with greater protection from public scrutiny, confining their thoughts to committees in government circles, universities, charitable institutions, or hospitals. But what exactly is it that bioethicists have to offer in such contexts? What sort of expertise do bioethicists have that justifies their employment on these committees, or the time and space accorded to their views on television and the radio, or in newspapers and magazines? In spite of being an expanding group of professionals who attract large sums of private and public funding, bioethicists are sometimes met with suspicion or even hostility, both inside and outside academia. One common criticism is that the presence of bioethicists is unproductive in practical bioethical debate. Abstract The paper explicates a set of criteria the joint satisfaction of which is taken to qualify moral judgements as cognitive. The paper examines evidence that some moral judgements meet these criteria, and relates the resulting conception of moral judgements to ongoing controversies about cognitivism in ethics.

The paper distinguishes three strategies by means of which empirical discoveries about the nature of morality can be used to undermine moral judgements. On the first strategy, moral judgements are shown to be unjustified in virtue of being shown to rest on ignorance or false belief. On the second strategy, moral judgements are shown to be false by being shown to entail claims inconsistent with the relevant empirical discoveries. On the third strategy, moral judgements are shown to be false in (...) virtue of being shown to be unjustified; truth having been defined epistemologically in terms of justification. By interpreting three recent error theoretical arguments in light of these strategies, the paper evaluates the epistemological and metaphysical relevance of empirical discoveries about morality as a naturally evolved phenomenon. This paper is about the relationship between two widely accepted and apparently conflicting claims about how we should understand the notion of ‘reason giving’ invoked in theorising about reasons for action. According to the first claim, reasons are given by facts about the situation of agents. According to the second claim, reasons are given by ends. I argue that the apparent conflict between these two claims is less deep than is generally recognised.

According to one version of objectivism about value, ethical and other evaluative claims have a fixed truth-value independently of who makes them or the society in which they happen to live (c.f. Davidson 2004, 42). Subjectivists about value deny this claim. According to subjectivism so understood, ethical and other evaluative claims have no fixed truth-value, either because their truth-value is dependent on who makes them, or because they have no truth-value at all.

Online news sites have become an internet ‘staple’, but we know little of the forces driving the popularity of such sites in relation to what could be understood as the latest iteration of the web – social media services. This research in brief article discusses empirical results regarding the uses of Twitter for news sharing. Specifically, we present a comparative analysis of links emanating from the service at hand to a series of media outlets over a six-month period in two (...) countries; Sweden and Norway. Focusing on linking practices among highly active Twitter accounts, we problematize the assumption that online communication involves two or more humans by directing attention to more or less automated ‘bot’ accounts. In sum, it is suggested that such automated accounts need to be dealt with more explicitly by researchers as well as practitioners interested in the popularity of online news as expressed through social media activity. Many of Søren Kierkegaard's most controversial and influential ideas are more relevant than ever to contemporary debates on ethics, philosophy of religion and selfhood. Kierkegaard develops an original argument according to which wholeheartedness requires both moral and religious commitment. In this book, Roe Fremstedal provides a compelling reconstruction of how Kierkegaard develops wholeheartedness in the context of his views on moral psychology, meta-ethics and the ethics of religious belief. He shows that Kierkegaard's influential account of despair, selfhood, ethics and religion (...) belongs to a larger intellectual context in which German philosophers such as Kant and Fichte play crucial roles. Moreover, Fremstedal makes a solid case for the controversial claim that religion supports ethics, instead of contradicting it. His book offers a novel and comprehensive reading of Kierkegaard, drawing on important sources that are little known. (shrink)

The aim of this paper is to identify and evaluate some of the most serious objections to the view that morality is a social construction. Among the objections considered are the claims that this view is incoherent; that it over-generates moral truths; that it under-generates moral truths; that it fails to capture the modal status of some moral truths; and that it fails to account for the phenomenology of moral experience. In each case, the objections are found wanting. This article offers a critical analysis of Blake’s ‘jurisdictional theory’ of the border control and, especially, its state-based methodology. It then draws on this analysis to discuss the merits of analysing global migration through the lens of ‘the right to exclude’. Blake’s theory demands serious attention in light of its promise to combine a normative account of exclusion with an uncontroversial descriptive account of the state. Despite its initial appeal, however, the theory is shown to face serious problems. First, its (...) central normative principle turns out to be able to yield an account of justified exclusion only at the cost of departing from the theory’s purported emphasis on the state. Second, and more importantly, its state-based methodology is shown to be unable to generate a convincing account of the legitimacy of border control, as opposed to the justice of exclusion. It is argued that this point is relevant for the analytical debate on immigration and borders more generally, in light of institutional phenomena that characterise the contemporary practice of border control. In this context, an excessive focus on the right to exclude can work to mask significant exercises of state power. (shrink)

According to some, taking moral testimony is a potentially decent way to exercise one's moral agency. According to others, it amounts to a failure to live up to minimal standards of moral worth. What's the issue? Is it conceptual or empirical? Is it epistemological or moral? Is there a ‘puzzle’ of moral testimony; or are there many, or none? I argue that there is no distinctive puzzle of moral testimony. The question of its legitimacy is as much a moral or (...) political as an epistemological question. Its answer is as much a matter of contingent empirical fact as a matter of a priori necessity. During parts of 2020, the presence of this deadly virus made national governments ‘lock down’ their economies and ‘lock up’ their citizens in a manner that has not previously been (...) seen in modern peacetime. This article tries to make sense of the concept of the highest good (eternal bliss) in Søren Kierkegaard by comparing it to the analysis of the highest good found in Immanuel Kant. The comparison with Kant’s more systematic analysis helps us clarify the meaning and importance of the concept in Kierkegaard as well as to shed new light on the conceptual relation between Kant and Kierkegaard. The article argues that the concept of the highest good is of systematic importance in (...) Kierkegaard, although previous research has tended to overlook this, no doubt due to Kierkegaard’s cryptic use of the concept. It is argued that Kierkegaard’s concept of the highest good is much closer to Kant’s than what previous research has indicated. In particular, Kant and Kierkegaard see the highest good not only as comprising of virtue and happiness (bliss), but also as being the Kingdom of God. (shrink)

By comparing the theories of evil found in Kant and Kierkegaard, this article aims to shed new light on Kierkegaard, as well as on the historical and conceptual relations between the two philosophers. The author shows that there is considerable overlap between Kant's doctrine of radical evil and Kierkegaard's views on guilt and sin and argues that Kierkegaard approved of the doctrine of radical evil. Although Kierkegaard's distinction between guilt and sin breaks radically with Kant, there are more Kantian elements (...) in Kierkegaard than was shown by earlier scholarship. Finally, Kierkegaard provides an alternative solution to the problem of the universality of guilt, a problem much discussed in the literature on Kant. (shrink)

This chapter focuses on how Kierkegaard criticizes both eudaimonism and Kantian autonomy for failing to account for unconditional obligations and genuine other-regard. Like Kant, Kierkegaard argues that eudaimonism makes moral virtue contingent on prudence. Kierkegaard views eudaimonism as an anthropocentric and self-regarding doctrine, which he contrasts not with Kantian autonomy but with theocentrism and proper other-regard. Kierkegaard then criticizes Kantian autonomy in much the same way as he criticizes eudaimonism. Whereas eudaimonism makes morality contingent on prudence, autonomy makes morality contingent (...) on decisions that may be revoked, he argues. As a result, human autonomy can account for hypothetical imperatives but not categorical imperatives. This line of reasoning seems problematic, however, since Kierkegaard takes Kantian autonomy to not only represent a form of moral constructivism, but also a form of moral relativism and decisionism. Still, Kierkegaard’s critique of autonomy indicates that morality and practical rationality need unconditional commitment towards what is objectively good. (shrink)

The aim of this paper is to clarify Kierkegaard’s concept of demonic despair (and demonic evil) and to show its relevance for discussions of the guise of the good thesis (i.e. that in f-ing intentionally, we take f-ing to be good). Contemporary discussions of diabolic evil often emphasise the phenomena of despair and acedia as apparent counter-examples to the guise of the good. I contend that Kierkegaard’s analysis of despair is relevant to these discussions, because it reconciles demonic (extreme) despair (...) and acedia with the guise of the good. In The Sickness unto Death, Kierkegaard provides an influential, systematic account of despair that relates evil, despair, and acedia to each other. Michelle Kosch argues that this account goes beyond Kierkegaard’s German predecessors by introducing a concept of diabolic evil and despair. By contrast, the present paper argues that Kierkegaard takes diabolic evil to be impossible, although he offers a rich analysis of the demonic that resembles diabolic agency. Still, Kierkegaard’s analysis rests on ontological assumptions about the nature of the good that belong to a Platonico-Christian tradition that is controversial today. (shrink)

The aim of this paper is to explore a pragmatic approach to hope and the ethics of belief that allows rational hope against hope. Hope against hope is hope that goes beyond what the evidence supports by hoping for something that is both highly unlikely and highly valuable. However, this could take different forms. One could either hope against the evidence or merely go beyond it; the evidence could be inconclusive or conclusive, conflicting or clear, misleading or plain, absent or (...) neutral. Hope against hope then covers everything from hoping for something that appears unlikely to hoping for something that appears impossible, judging by the available evidence. However, there is a very long tradition of criticizing hope for being false or irrational. But hope can only be false or irrational if it is subject to rational assessment. This presupposes that it is appropriate to ask for a reason or a justification for hoping, since one can be answerable or responsible for hoping. Moreover, this typically assumes that hopes can be changed in response to reasons. False hopes, notably, should be given up (if possible). However, if hope is subject to rational assessment, it is also possible for hope to be rational or justified. Indeed, I will explore how practical reasons or pragmatic considerations may justify hope against hope, sketching criteria for rational hope that allow hope against hope. Section I introduces evidentialism and pragmatism regarding belief. Sections II and III discuss whether or not rational hope against hope is compatible with evidentialism, favoring a pragmatist approach to hope and belief. Section IV discusses evidentialism and pragmatism, whereas sections V-VII sketch constraints on pragmatism and rational hope. (shrink)

In his book The Moral Problem and in a recent issue of this journal, Michael Smith claims to refute any theory which construes the relationship between moral judgements and motivation as contingent and rationally optional. Smith’s argument fails. In showing how it fails, I shall make three claims. First, a concern for what is right, where this is read de dicto, does not amount to moral fetishism. Second, it is not always morally preferable to care about what is right, where (...) this is read de re. Third, the externalist can account for why a good and strong-willed person is reliably motivated in accordance with her moral judgements without appealing to a basic moral motive to do what is right, where this is read de dicto. This article investigates the convergence between Kierkegaard’s concept of despair and Nietzsche’s concept of nihilism. The piece argues that (1) both Kierkegaard and Nietzsche rely on an internal critique of ways of life which collapse on their own terms; (2) both despair and nihilism involve a radical, existential aporia and double-mindedness which can be (3) either conscious or non-conscious; (4) there is some overlap between the main types of nihilism and the different types of inauthentic (non-conscious) despair; (5) finally, a (...) comparison with Nietzsche makes it possible to make sense of inauthentic despair without resorting to theological presuppositions or a twentieth century depth psychology notion of the unconscious. In 1954 Hempel wrote “Once the idea of a partial specification of meaning is granted, it appears unnecessarily restrictive, however, to limit the sentences effecting such partial interpretation to reduction sentences in Carnap's sense. … Generally, then, a set of one or more theoretical terms, t1, t2 ⃛, tn, might be introduced by any set M of sentences such that M contains no extralogical terms other than t1, t2 ⃛, tn, and observation terms, M is logically consistent, and M is (...) not equivalent to a truth of formal logic. The last two of these conditions serve merely to exclude trivial extreme cases. A set M of this kind will be referred to briefly as an interpretative system, its elements as interpretative sentences.” This is the last move in a process in which the idea of definition has been widened beyond the explicit or equivalence definition which was the basis of earlier thought on the subject of introducing new words into a language. It would seem that the scheme proposed by Hempel must represent the final move, for it would seem difficult to conceive any more liberal description of a purely direct and verbal scheme. Among the predecessors of Hempel in this liberalising movement I will mention Ramsey and Braithwaite whose views stem ultimately from Campbell, and are based on the idea that the “interpretative system” is essentially a scientific theory, and Carnap who introduced the particular notion of a “reduction sentence”, and who was more directly the source of Hempel's own ideas. The aims of this paper are fourfold. The first aim is to characterize two distinct forms of circumstantial moral luck and illustrate how they are implicitly recognized in pre-theoretical moral thought. The second aim is to identify a significant difference between the ways in which these two kinds of circumstantial luck are morally relevant. The third aim is to show how the acceptance of circumstantial moral luck relates to the acceptance of resultant moral luck.
